1. A U.S. patent application must be filed within one year of your first public disclosure or offer for sale of the invention. A public disclosure before filing a patent application will most likely prevent you from obtaining patent protection in most foreign countries.

2. A patent bestows the right to prevent others from making, using, or selling the claimed invention. Securing a patent does not bestow the right to practice the invention, that is, practicing the invention could infringe the patents of others.

Is the concept novel

and inventive—and not

simply a minor tweak of

something known and

did you invent it? 1

Is the invention life

significantly longer

than application pendency

period (about 3.5 years)?

Is someone likely

to infringe

(and adversely

affect sales)? 2

Pursuing

PATENT PROTECTION

may be an appropriate

course of action.

Will expected profits or competitive advantages

justify patent costs

($5000+)?

This is not a strong candidate for a patent.
